1. Introduction

Welcome to nagaya.si.

These Terms & Conditions govern your use of this website and the purchase of products offered through it. By accessing the website or placing an order, you agree to these Terms.

The website is operated by Nagaya, an independent maker of handcrafted garments.

2. Products

All garments are designed and handcrafted with care. Some items are available from stock, while others are produced after an order is placed or offered on backorder as part of our small-scale production approach.

As each piece is handmade, slight variations in colour, texture, pattern placement, or finishing may occur. Such variations are a natural part of the production process and do not constitute defects.

Product photographs are intended to represent the items as accurately as possible. However, colours may appear differently depending on your screen or device settings.

3. Availability

All products are offered subject to availability.

We reserve the right to discontinue, modify, or update products at any time without prior notice.

4. Ordering

By placing an order, you confirm that:

  • You are legally capable of entering into a binding agreement.
  • The information provided during checkout is accurate and complete.
  • You are authorised to use the selected payment method.

After an order is placed, you will receive an order confirmation by email. This confirmation does not guarantee immediate acceptance of the order.

5. Prices and Payment

All prices are displayed in Euros (€).

Applicable taxes are included where required by law unless otherwise stated.

Payment must be completed before an order is produced and shipped.

We reserve the right to modify prices at any time, although changes will not affect orders already confirmed.

6. Production and Processing Time

Some garments are available from stock and can usually be prepared for dispatch within a few business days.

Other garments may be produced after an order is placed or offered on backorder. Production times vary depending on the garment, available materials and current workload.

Where estimated production times are provided, they should be considered approximate rather than guaranteed.

If unexpected delays occur, we will make reasonable efforts to inform you.

7. Shipping

We currently ship within Europe.

Shipping costs and available delivery options are shown during checkout.

Delivery times are estimates and may vary due to factors outside our control, including postal delays, customs procedures, weather conditions, or carrier disruptions.

Once a shipment has been handed over to the carrier, responsibility for delivery rests with the shipping provider.

8. Sustainability and Zero-Waste Production

Nagaya aims to minimise waste through thoughtful pattern cutting, responsible material use and small-scale production.

To avoid unnecessary overproduction, some garments may be made after an order is placed, while others are produced in limited quantities and kept in stock.

9. Sizing and Customer Responsibility

Customers are responsible for reviewing product descriptions, measurements, and sizing information before placing an order.

If you are unsure about sizing, please contact us before purchasing.

We cannot guarantee fit, as body proportions vary between individuals.

10. Right of Withdrawal and Returns

Customers have the right to withdraw from their purchase within 14 days of receiving their order, in accordance with applicable consumer protection laws.

To be eligible for a return:

  • The item must be unworn, unused and in its original condition.
  • The item must be returned within 14 days of notifying us of your withdrawal.
  • The customer is responsible for return shipping costs unless the item is faulty, damaged or incorrect.

In-stock and made-to-order garments are eligible for returns under the same conditions, unless otherwise stated on the product page.

11. Faulty or Incorrect Items

If you receive a defective, damaged, or incorrect item, please contact us within a reasonable time after delivery.

Where a fault is confirmed, we will offer an appropriate remedy, which may include repair, replacement, or refund, depending on the circumstances and applicable law.

12. Intellectual Property

All content on this website, including photographs, designs, text, graphics, logos, and branding, remains the property of Nagaya unless otherwise stated.

Content may not be copied, reproduced, distributed, or used without prior written permission.

13. Limitation of Liability

To the extent permitted by law, Nagaya shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or the purchase of products.

Nothing in these Terms excludes rights that cannot be excluded under applicable consumer protection legislation.

14. Privacy

Personal data is processed in accordance with our Privacy Policy.

15. Governing Law

These Terms & Conditions are governed by the laws of Slovenia.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts of Slovenia, without prejudice to mandatory consumer protection rights available under applicable European Union legislation.

16. About this website

This website is intentionally simple, privacy-focused and designed to respect your time and attention. We do not use manipulative sales tactics, behavioural tracking or unnecessary cookies. Product information, pricing and availability are presented as clearly and transparently as possible, and we only collect the information needed to process and deliver your order. All website data is hosted on secure servers in Slovenia, while payments are handled securely by Stripe, Google Pay and Apple Pay. Every photograph, product description and piece of written content on this website has been created by a real person and reviewed before publication.
